Article 1: Scope and Modification of the General Terms and Conditions of Sale

These general terms and conditions of sale apply to all orders placed on the Supercharged website.

Supercharged® reserves the right to adapt or modify these general terms and conditions of sale at any time. In case of modification, the general terms and conditions of sale in force at the time of the order will apply.


Article 2: Product Availability

Our product offers and prices are valid as long as they are visible on the site, subject to stock availability. Upon receiving your order, we will check the availability of the product(s) ordered. In case of unavailability, we commit to delivering the ordered product within 30 days from the order confirmation or offering a similar product at a similar price, or refunding you. To properly process your request, please remind us of your order number and your complete contact details.


Article 3: Orders

Automatic registration systems are considered as proof of the nature and content of the order. Supercharged® confirms the acceptance of the order to the client at the email address provided. The sale will be concluded from the validation by Supercharged® of the payment of the order, i.e., from the date of payment validation for orders paid online by credit card. Supercharged® reserves the right to refuse or cancel any order from a customer with whom there is a dispute regarding the payment of a previous order.



Article 4: Prices

The prices indicated in euros are deemed net, excluding shipping costs. This price includes the cost of the products, handling, packaging, and product conservation fees. They are subject to change at any time without notice, knowing that the items will be invoiced based on the rates in force at the time of the order registration. All orders are invoiced in euros and payable in euros. Any customs duties or local taxes remain the responsibility of the recipient.



Article 5: Payment Methods and Security


Payment can be made by:

  • Credit card (VISA, MASTERCARD, iDeal, Bancontact, JCB, or AMERICAN EXPRESS)
  • Paypal

The payment is made on the secure banking servers of our partner. This implies that no banking information about you passes through the Supercharged site. Credit card payment is therefore perfectly secure; your order will be recorded and validated as soon as the payment is accepted by the bank you have chosen.


Security:

Your credit card details are encrypted using the SSL (Secure Socket Layer) protocol and never transmitted unencrypted over the network. Payment is made directly to the bank. Supercharged has no access to these details, and does not keep them on its servers. This is why they are requested for each new transaction on our site.


Retention of title clause:


The products remain the property of Supercharged until the complete payment of the order by Supercharged. However, from the moment the order is received by the customer, the risks of the delivered goods are transferred to the customer.


Default of Payment


Supercharged reserves the right to refuse to make a delivery or to honor an order from a consumer who has not fully paid for a previous order or with whom a payment dispute is being administered.


Anti-Fraud Checks


Supercharged checks all the orders that have been validated on its site. These controls aim to protect Supercharged from abusive practices operated by fraudsters. As part of these procedures, our services may ask you for all the documents necessary to unblock your order: proof of address and debit in your name, etc. These requests are made by email and by phone. Supercharged reserves the right not to ship the merchandise if the requested documents are not received by Supercharged®. The documents must be sent either by email or by postal mail.


Card Refused

In the case of payment by credit card, two scenarios are possible:

  1. the payment is accepted, and the order proceeds
  2. the payment is refused:

o either the payment is blocked by the inter-bank network, the customer is then notified by email, and the order is automatically put on hold. The customer must then contact Supercharged to change the payment method.

o The products remain the property of Supercharged until the complete payment of the order by Supercharged. However, from the moment the order is received by the customer, the risks of the delivered goods are transferred to the customer.


Article 6: Payment Security


> Transaction security (SSL encryption)

Credit card payment is secured by STRIPE, known for its reliability in Internet transactions. The transaction between you and STRIPE is encrypted (SSL). The bank information you provide, encrypted on your own computer, will never circulate unencrypted on the Internet.

Article 7: Delivery Terms and Delivery Times


General


Products are delivered to the delivery address you provided during the ordering process.


Costs


The costs of participating in the preparation and shipment of the order are entirely free.


Delivery Times


The indicated times are average times and correspond to the processing, preparation, and shipment times of your order (warehouse exit). To this time, the delivery time of the carrier must be added. The announced delivery time of 10 to 20 days is valid from the receipt by the buyer of the order delivery email. The delivery time (announced by the carrier) does not in any way commit Supercharged® to a longer time.


Delivery times during Covid-19 or a similar pandemic may be up to 60 business days.



Article 8: Returns

If products need to be returned to us, they must be the subject of a return request to our Customer Service within 14 days following delivery. Any claim made outside this period will not be accepted. The return of the product can only be accepted for products in their original condition. If at the time of delivery, the original packaging is damaged, torn, or opened, you must then check the condition of the items. If they have been damaged, you must absolutely refuse the package and note a reserve on the delivery slip (package refused because opened or damaged).


Does not live at the indicated address

If a package is returned with the reason from La Poste "NPAI", Supercharged® is entitled to request additional shipping costs if:

  • < span style="font-weight: 400;">the address was incorrectly entered by the customer in the order form
  • the address entered by the customer in the order form is incorrect or incomplete

On the other hand, Supercharged will open an investigation for "abusive return" and resend the package without requesting additional Fees if the carrier is declared at fault.


Unclaimed Package


If a package is returned to us with the reason "Unclaimed", Supercharged is entitled to request additional shipping costs for resending the package. ATTENTION: in case of NON-CLAIMED package return to Supercharged for more than 15 days (i.e., 30 days in total between the 15 days of postal services return delay and 15 days of return storage at Supercharged), the order can no longer be canceled or refunded.


Lost Package


In case of a delivery dispute, Supercharged reserves the right to request an ID with the signature of the customer and/or of the person residing at the delivery address and/or of the person likely to have received the package. In case of refusal, Supercharged will then not proceed with any refund or product exchange.


Claim (delays)


Each order is subject to the sending of a shipment confirmation email as well as a publication of the shipment consultable in the customer account. No claim for an unreceived, lost, or damaged package will be accepted beyond 30 days after the shipment date of the order.

Good Faith Clause


Supercharged commits to informing the customer of the delivery of his order:

  • via an automatic email (to the email address indicated at the time of the order).
  • via the opening and management of potential dispute files with carriers

It is the customer's good faith to use its services to know the progress of the delivery of his order. A customer complaint not having been made within the framework of the use of its services within 20 days after shipment of the order cannot be subject to a refund or even the opening of a file at Supercharged.


Delivery outside the zone and customs duty.


All our prices are understood excluding customs fees. Outside the European Union, customs fees may be claimed by the destination country of the order. These fees are always the responsibility of the recipient and cannot be calculated in advance by Supercharged. These fees are levied by the customs of the destination country and not by Supercharged. Please approach the customs service of your national territory for any questions on this subject.

Article 8: Responsibilities

  • Supercharged cannot be held responsible for the non-performance of the contract concluded on the occasion, of force majeure, or in case of total or partial strike of postal services, carriers, and disasters caused by floods or fires.


  • The choice and purchase of a product or service are placed under the sole responsibility of the customer. The total or partial impossibility of using the products notably due to equipment incompatibility cannot give rise to any compensation, refund, or questioning of Supercharged's responsibility, except in the case of a hidden defect, non-conformity, defectiveness, or exercise of the right of withdrawal envisaged under article 8.


  • In case of non-delivery of an order or part of an order,

- If the package is marked as delivered by the carrier, you have a period of 14 days from the delivery date announced by the carrier to submit a claim.

- If the package is not marked delivered by the carrier or encounters a delivery problem and is not returned to the sender, you have a period of 30 days from the shipping date to submit a claim.

Beyond the deadlines announced above, we will accept no claim.


Article 9: Right of Withdrawal


You have 7 days to return any article and request an exchange or refund without penalty, except for the return costs. You must obtain your return agreement number before returning your product (see paragraph 9, return procedure). The product must necessarily be returned in perfect condition, in its original packaging undamaged. It must be accompanied by all its accessories (instructions, cords, remote controls, warranties, etc.). Otherwise, you will lose your right of withdrawal, and the product will be returned to you at your expense.


ARTICLE 10: TRANSFER OF OWNERSHIP - TRANSFER OF RISKS

The transfer of ownership of the products to the purchaser will only be carried out after full payment of the price by the latter, regardless of the delivery date of said products. On the other hand, the transfer of the risks of loss and deterioration of the products will be carried out upon delivery and receipt of said products by the purchaser.

Supercharged® is the producer and owner of all or part of the databases making up this site. By accessing this site, the customer acknowledges that the data composing it are legally protected, and is prohibited in particular from extracting, reusing, storing, reproducing, representing, or conserving, directly or indirectly, on any type of support, by any means and in any form whatsoever, all or a qualitatively or quantitatively substantial part of the content of the databases appearing on the site to which he accesses.

The descriptions of the products present in the databases were entered based on the information provided by the publishers. Supercharged® is not responsible for the content of the works and cannot be held liable to the purchaser. Supercharged®'s liability cannot be sought in the event of force majeure (strike, flood, fire...).

The products offered comply with New Mexico (USA)'s law in force. We decline any responsibility if the delivered item does not respect the legislation of the country of delivery (censorship, prohibition of a title or an author...). Supercharged® is not responsible for the content of websites that hyperlinks may refer to from its own site.

ARTICLE 13: APPLICABLE LAW

All the clauses appearing in these general terms and conditions of sale, as well as all the purchase and sale transactions referred to therein, will be subject to New Mexico law (United States of America).

ARTICLE 14: ACCEPTANCE OF THE PURCHASER

These general terms and conditions of sale as well as the rates are expressly agreed to and accepted by the purchaser, who declares and acknowledges having perfect knowledge of them, and therefore waives the right to rely on any contradictory document and, in particular, its own general conditions of purchase, the act of purchase entailing acceptance of these general terms and conditions of sale.

Article 15: APPLICABLE VAT

Born 2 Win LLC has its head office outside the European Union (USA) and delegates its shipping and storage logistics to a third-party company outside the European Union (Hong Kong). Born 2 Win LLC does not store and does not ship products, therefore, the customer is considered the importer of his product and is responsible for the VAT of his country.
